Article 1. Identity of the publisher and scope of application
The e-commerce site https://olivier-morin.fr is published by Domaine Olivier Morin, a family business located at 2 chemin de Vaudu, 89530 Chitry, France. Contact customer service: chitry@olivier-morin.fr and 06 26 32 04 26. These General Terms and Conditions of Sale govern, without restriction or reservation, all sales concluded between Domaine Olivier Morin (hereinafter "the Seller") and any individual consumer or non-professional within the meaning of the Consumer Code (hereinafter "the Customer") making a purchase on the Site. Any order implies full and complete acceptance of these terms and conditions.
Article 2. Capacity, legal age and health warning
The sale of alcohol is reserved for adults aged 18 or over. By confirming the order, the Customer certifies that they are of legal age. Alcohol abuse is dangerous for your health; consume in moderation. The Seller may refuse the sale or delivery if there is serious doubt about the buyer's legal age.
Article 3. Product information
The wines offered for sale are described by information sheets indicating in particular the appellation, vintage, grape variety, volume, price, any special features and delivery constraints. The photographs are for illustrative purposes only. Vintages and availability may vary depending on stock levels. The Products comply with French regulations.
Article 4. Price
Prices are quoted in euros, inclusive of all taxes, excluding delivery charges and, where applicable, excluding deposits and additional insurance. The applicable price is the one in effect at the time of ordering. Delivery charges and selected options are specified before validation and appear on the order summary.
Article 5. Order and formation of the contract
The Customer selects the Products, checks the basket, provides the necessary contact information, chooses the delivery method and the payment method, and then confirms their acceptance of these terms and conditions. Online payment finalizes the order. The contract is formed after payment confirmation. The Seller reserves the right to refuse any abnormal order, placed in bad faith, resulting from a previous dispute, or in the event of suspected fraud.
Article 6. Availability
Offers are subject to availability. In the event of unavailability after the order is placed, the Seller will inform the Customer by email and offer the Customer the option of an equivalent product, a credit note, or a refund of the amount paid for the unavailable item within seven working days.
Article 7. Payment
Payment is made in cash when ordering by credit card via a secure solution compliant with payment services regulations and strong authentication (SCA) when required. The Seller may request additional supporting documents in the event of an anti-fraud check. Any amount not paid on the due date will bear interest at the legal rate from the date of formal notice.
Article 8. Reservation of ownership and transfer of risks
The Seller retains ownership of the Products until full payment of the price. The risks of loss and damage are transferred to the Customer upon taking physical possession of the Products.
Article 9. Delivery
Deliveries are made in mainland France and, upon request, in certain areas of the European Union. The indicative delivery time is three to seven working days from payment confirmation, unless specifically stated on the product sheet or in cases of force majeure. Delivery means the transfer to the Customer of physical possession of the Products to the address indicated when ordering. The Customer must check the accuracy of the address and the presence of a recipient. In the event of an incorrect address, absence at the time of presentation, or failure to collect the Products within the time limit from the relay point, new presentation or reshipping fees may be charged.
Article 10. Reception, reservations and transport anomalies
The Customer is required to check the condition of the packages and the conformity of the delivery upon receipt. In the event of damaged, apparent breakage, missing or incorrectly referenced packages, the Customer must make specific reservations to the carrier and inform the Seller by email at chitry@olivier-morin.fr within twenty-four hours, with supporting photos (packages, bottles, carrier label). In the absence of reservations and notification within this period, the delivery is deemed to be compliant, without prejudice to legal guarantees.
Article 11. Consumers' right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Consumer Customer has a period of fourteen days from receipt to exercise his right of withdrawal without having to justify his decision or bear any costs other than those of return. The Customer notifies his decision by an unambiguous declaration or by using the standard form reproduced at the end of this document. The Products must be returned within fourteen days of notification, in perfect condition for resale, unopened, in the complete original packaging. The Seller will reimburse all payments received, including standard delivery costs, no later than fourteen days from recovery of the Products or proof of shipment, by the same means of payment. Return costs remain the responsibility of the Customer. Opened or unsealed bottles and, more generally, goods that cannot be returned for reasons of hygiene or health protection once unsealed are excluded from the right of withdrawal.
Article 12. Quality policy and reporting within 24 hours
Regardless of the legal right of withdrawal, any problem of breakage during transport, obvious non-conformity or missing items must be reported to customer service within twenty-four hours of receipt with photographic evidence. After verification, the Seller may proceed with the replacement, credit note or refund of the items concerned. Return and reshipping costs are covered when the anomaly is proven.
Article 13. Legal guarantees
The Products benefit from the legal guarantee of conformity (articles L.217-3 to L.217-20 of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code). The consumer Customer has a period of two years from delivery to act in conformity, can choose between repair or replacement of the good, and is exempt from proving the existence of the defect during the twenty-four months following delivery. In respect of hidden defects, the buyer can choose the resolution of the sale or a price reduction. These guarantees apply independently of any commercial guarantee.
Article 14. Liability
The Seller shall not be liable in the event of non-performance or poor performance attributable to the Customer, to the insurmountable and unforeseeable act of a third party to the contract or to a case of force majeure within the meaning of Article 1218 of the Civil Code. The Customer is solely responsible for the conservation of the wines after delivery, in particular the conditions of temperature, humidity, light and storage.
Article 15. Personal data

Article 16. Intellectual Property
The Site and all of its elements are protected by copyright and trademark law. Any reproduction, representation or adaptation, in whole or in part, without prior authorization is prohibited.
Article 17. Customer reviews
Published reviews may be subject to moderation to verify their connection to an actual purchase and compliance with rules of courtesy and legality. The Seller may respond to reviews. Reviews that violate the law or are clearly unrelated to a purchasing experience may be refused or deleted.

In the event of an unresolved dispute, the consumer Customer can have free recourse to the CM2C consumer mediator (https://www.cm2c.net) or to the European online dispute resolution platform (https://ec.europa.eu/consumers/odr).
Article 19. Applicable law and jurisdiction
These terms are governed by French law. French courts have jurisdiction without prejudice to the mandatory protective provisions of the consumer's country of residence within the European Union.
Article 20. Proof, archiving and modification of the T&Cs
Automated records stored in the systems of the Seller and its service providers under reasonable security conditions constitute proof of communications, orders and payments. Purchase orders and invoices are archived in accordance with the law. The Seller may modify these terms and conditions at any time; the applicable GTC are those in effect on the date of the order.
